Total Welfare Solutions PTY LTD. (ABN: 48 695 526 839) ("WelfareCheckr", "we", "us", "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, and disclose personal information in connection with the WelfareCheckr website (www.welfarecheckr.com) and app (together, the "Service").
This Policy is intended to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). It should be read alongside our Terms and Conditions (https://www.welfarecheckr.com/terms-of-service).
1. The Kind of Information We Collect
We collect the following types of information:
Account information: name, email address, password (encrypted), and profile details you provide (e.g. role/occupation as a first responder, employer/agency if you choose to provide it).
Wellness data: self-reported entries you make within the Service, including fatigue, stress, mood, sleep, and related wellbeing indicators, and any notes or journal entries you choose to add.
Subscription and payment information: subscription plan, billing history, and transaction records. Full card details are collected and processed directly by Apple or Google Play payment processor — we do not store your full card number.
Technical information: device type, operating system, IP address, app usage and log data, collected automatically when you use the Service.
Communications: records of correspondence if you contact our support team.
2. Sensitive Information
Wellness data you enter — including mood, stress, and fatigue indicators — may constitute sensitive information and/or health information under the Privacy Act. Under the Australian Privacy Principles, we are required to obtain your express consent, separate from general acceptance of our Terms, before collecting this category of information.
Accordingly, during account set-up you will be shown a standalone consent screen that specifically names the categories of wellness/health-related data the Service collects, and asks you to actively confirm your consent before you can begin entering that data. You are not required to enter any specific data point; entries are voluntary, and you may withdraw consent at any time by deleting your account (see Section 11).
3. How We Collect Information
We collect information:
• directly from you, when you create an account, enter data, or contact us;
• automatically, through your use of the Service (e.g. app analytics, log data); and
• from third parties, such as our payment processor, confirming subscription/payment status.
4. How We Use Your Information
We use your information to:
• provide, maintain, and improve the Service, including displaying your wellness trends back to you;
• process subscription payments and manage your account;
• communicate with you about your account, updates, or support requests;
• monitor and improve the security and performance of the Service; and
• comply with our legal obligations.
We do not use your wellness data to make automated decisions about your employment, fitness for duty, or medical status.
Currently, we do not share your individual wellness data with any employer, agency, or organisation. In the future, we may offer a version of the Service to corporate or agency partners (e.g. your employer or agency). If this applies to you, only specified data — as agreed between WelfareCheckr and that organisation, and disclosed to you at the time — would be shared, and you would be notified of exactly what is and is not shared before it takes effect. Certain information will always remain private and confidential to you regardless of any such arrangement.
If your employer or agency becomes a partner organisation after you have already created an individual account, we will ask for your separate, specific consent before any of your existing data is shared with that organisation. You may decline this sharing and continue using the Service on an individual basis, subject to the features available under that arrangement. Where an organisation is given access to any data, separate terms and conditions specific to that arrangement will govern what is shared, and this Policy will be updated accordingly.
We do not sell your personal information.
5. Disclosure of Information
We may disclose personal information to:
• Service providers who help us operate the Service, such as cloud hosting providers and our payment processor, bound by confidentiality and data protection obligations;
• Law enforcement or regulators, where required by law; and
• A third party, in the event of a business sale, merger, or restructure, subject to this Policy continuing to apply to your information.
We do not disclose your individual wellness entries to any third party for marketing purposes.
6. Overseas Disclosure
Some of our service providers (e.g. cloud hosting, payment processing) may store or process data outside Australia. Where this occurs, we take reasonable steps to ensure overseas recipients handle your information consistently with the Australian Privacy Principles, including through contractual protections.
Your account and wellness data are hosted on servers located in Australia. However, it is important to note that payments are processed via Apple and Google Play, which are companies based overseas (including the United States), so some data (such as subscription/billing status) is likely to be disclosed overseas regardless of where the Service itself is hosted.
7. Data Security
We use reasonable technical and organisational measures to protect your information, including encryption of stored passwords and access controls on wellness data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Data Breach Notification
If we experience a data breach that is likely to result in serious harm to you — which is more likely where sensitive information such as wellness data is involved — we will comply with our obligations under the Notifiable Data Breaches (NDB) scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.
9. Data Retention
We retain your personal information for as long as your account is active. If you delete your account, we will delete or de-identify your personal information, including wellness data, within 90 days, except where we are required by law to retain specific records for longer (e.g. financial records for tax purposes), in which case only that specific information is retained for the legally required period. You may request deletion of your account and data at any time (see Section 11).
10. Not a Crisis or Monitoring Service
As set out in our Terms and Conditions, WelfareCheckr does not actively monitor entries in real time and does not notify emergency services or third parties based on the content of your entries, unless you have explicitly opted into a feature that does so. Do not rely on the Service for emergency support — call 000 in an emergency.
11. Your Rights
Under the Australian Privacy Principles, you have the right to:
• access the personal information we hold about you;
• correct inaccurate or outdated information;
• request deletion of your account and associated data, subject to any legal retention requirements; and
• make a complaint if you believe we have mishandled your information.
To exercise any of these rights, contact us at support@welfarecheckr.com. We will respond within a reasonable timeframe, generally within 30 days.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
12. Cookies and Analytics
Our website and app may use essential cookies to remember your preferences and ensure the Service functions correctly. We do not currently use third-party analytics or advertising cookies. If we introduce analytics or tracking tools in the future, we will update this Policy and notify all users. You can control cookies through your browser settings.
13. Children
The Service is not intended for individuals under 18. We do not knowingly collect personal information from anyone under 18.
14. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be notified to you via email or in-app notice before they take effect. The "Last updated" date at the top of this Policy reflects the most recent version.
