
WelfareCheckr — Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the WelfareCheckr website (www.welfarecheckr.com) and the WelfareCheckr mobile/web application (together, the "Service"), provided by Total Welfare Solutions PTY LTD. (ABN 48 695 526 839) ("WelfareCheckr", "we", "us", "our").
By creating an account, subscribing to, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About WelfareCheckr
WelfareCheckr is a wellness companion app designed for first responders. It allows users to self-track indicators such as fatigue, stress, and mood over time, with the aim of helping individuals notice patterns before they escalate.
WelfareCheckr is a self-monitoring and wellness tool only. It is not:
• a medical device, diagnostic tool, or treatment service;
• a substitute for advice from a qualified medical, psychological, or mental health professional; or
• a crisis, emergency, or first-responder dispatch service.
2. Not a Crisis Service — Important Safety Notice
If you or someone else is in immediate danger, or you are experiencing a mental health crisis, do not rely on the Service. Call 000 (Australia) immediately.

WelfareCheckr does not monitor entries in real time, does not guarantee that concerning entries will be reviewed by any person, and does not notify emergency services or any third party on your behalf unless expressly stated in the Service.
By creating an account, you specifically acknowledge and accept this section. This acknowledgment is presented to you separately during account set-up and must be actively confirmed before you can use the Service.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you confirm that you meet these requirements.
4. Accounts
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate information when creating an account and keep it up to date.
• Notify us immediately at support@welfarecheckr.com if you suspect unauthorised use of your account.
5. Subscriptions and Payment
• Access to some or all features of the Service requires a paid subscription ("Subscription").
• Subscription fees, billing frequency, and available plans are displayed at the time of purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled prior to renewal.
• You may cancel your Subscription at any time via your Apple ID subscription settings (App Store) or your Google Play account subscription settings, depending on where you subscribed; cancellation takes effect at the end of the current billing period, and no partial refunds are provided for the remaining period except as required by law.
• We may change Subscription pricing by giving you at least 30 days' written notice before the change takes effect; changes will not apply to a billing period already paid for. If you do not agree to a pricing change, you may cancel your Subscription before it takes effect without penalty.
• Apple or Google Play Store processes payments; we do not store your full payment card details.
If we offer a free trial or free tier of the Service, its duration, features, and any conditions will be disclosed to you at the time it is offered, and this section will apply to any paid Subscription you take out afterwards.
6. Acceptable Use
You agree not to:
• use the Service for any unlawful purpose;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• reverse engineer, scrape, or resell the Service without our written consent;
• upload false information intended to mislead; or
• use the Service in a manner that could harm, disable, or overburden it.
We may suspend or terminate accounts that breach this section.
7. Your Data and Privacy
Our collection and handling of your personal information, including wellness data you enter into the Service, is set out in our Privacy Policy (https://www.welfarecheckr.com/privacy-policy) which forms part of these Terms. By using the Service, you consent to the collection and use of your data as described there.
Wellness and health-related information you provide is sensitive information. We take reasonable steps to protect it, but you should review the Privacy Policy for details on storage, access, and any sharing arrangements.
8. Intellectual Property
All content, branding, software, and materials that make up the Service are owned by WelfareCheckr or our licensors and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
You retain ownership of the wellness data, journal entries, and notes you create within the Service ("User Content"). We do not claim any ownership rights over your User Content. By entering User Content into the Service, you grant us a limited licence to store, process, and display it back to you solely for the purpose of providing the Service to you.
9. No Warranty
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, reliability, or fitness for a particular purpose.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
10. Limitation of Liability
To the maximum extent permitted by law:
• WelfareCheckr is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Service;
• WelfareCheckr's total liability for any claim arising out of or in connection with the Service is limited to the amount you paid for your Subscription in the 12 months preceding the claim; and
• WelfareCheckr is not liable for any decision you make, or fail to make, based on information or patterns shown in the Service, including decisions relating to your health, wellbeing, or fitness for duty. You specifically acknowledge, by accepting these Terms, that the Service is a self-monitoring tool only and that decisions about your health or fitness for duty should be made in consultation with a qualified professional, not on the basis of the Service alone.
Where liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to re-supplying the service or paying the cost of having the service re-supplied.
These limitations apply only to the extent permitted by law and are intended to operate reasonably and reciprocally — they do not remove your right to cancel under section 5 or section 13 where a change to the Service or these Terms is not acceptable to you.
11. Termination
We may suspend or terminate your access to the Service if you breach these Terms, or for operational or legal reasons on reasonable notice. You may stop using the Service and cancel your Subscription at any time as described in section 5.
12. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms where that failure or delay results from circumstances beyond our reasonable control, including natural disasters, internet or telecommunications outages, power failures, industrial action, or acts of government.
13. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide at least 30 days' notice (e.g. via email or in-app notice) before they take effect, and will ask you to actively confirm your acceptance of the updated Terms. If you do not agree to a material change, you may cancel your Subscription before the change takes effect and receive a pro-rata refund for any unused portion of your current billing period. Continued use of the Service after non-material changes take effect constitutes acceptance of those changes.
14. Dispute Resolution
If a dispute arises in connection with these Terms, you agree to first contact us at support@welfarecheckr.com and attempt to resolve the issue informally. If the dispute is not resolved within 30 days, either party may pursue any right or remedy available at law.
15. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and WelfareCheckr in relation to the Service and supersede any prior agreements or understandings.
16. Governing Law
The laws of Queensland, Australia govern these Terms. You submit to the non-exclusive jurisdiction of the courts of Queensland.
